A pre-trial to preclude challenging of the Principal’s transactions in the total amount of more than RUB 500 million

A Principal, who acquired an IT company, received a request from the bankruptcy trustee of the former parent company undergoing bankruptcy to disclose information on the transactions entered into during the suspect period. Should the transactions be recognized invalid, more than RUB 500 million could have been recovered from the company.

The task for KIAP was to analyze the company’s transactions, put in place a defense strategy and prepare a response to the bankruptcy trustee’s request to minimize the risks of challenging the transaction.

The efforts of KIAP associates enabled to collect sufficient scope of evidence and convince the trustee that challenging the transactions in court would be futile.
