Challenging land plots sale and purchase contracts worth over RUB 270 million

As transpired in examination of a bankruptcy case, the debtor’s spouse had sold land plots with the total area of more than 200,000 square meters and worth at least RUB 270 million. Furthermore, the money was actually transferred neither to the debtor’s wife nor to the debtor himself. The person affiliated with the debtor had acted as the buyer.

The complication in the dispute was the fact that shortly before the debtor’s bankruptcy, a marriage contract had been entered in respect of the plots in question, establishing the sole ownership of the wife, which became known when the plots sale and purchase contracts were challenged. Under these circumstances, the marriage contract should additionally be challenged.

KIAP was tasked with litigation in challenging said transactions and obtaining their invalidation. As a result of examining the disputes, the transactions were recognized invalid and the land plots were returned into the bankruptcy estate.
