As part of the bankruptcy case, a creditor’s application was handled that concerned inclusion in the register of creditors’ claims of the amount of RUB 160 million. KIAP was tasked with reviewing the evidence presented and originating a strategy to prevent the debt from being added in the register.
KIAP associates succeeded in proving the fact of defaulting on the limitation period and refuting the sufficiency of evidence related to the lender’s financial solvency at the time of formalizing the loan relationship with the debtor. As a result, the court dismissed the application to include the claim in the register of creditors’ claims.
