Protection of the Principal against vicarious liability for RUB 900 million

KIAP associates joined the Principal’s defense when the dispute had been pending for eighteen months already. The main problem was that the bankruptcy trustee challenged the transactions as damaging to the creditor, the total amount of which amounted to nearly 40% of the register of creditors’ claims. Moreover, the Principal had no documents that would enable its protection from being held liable.

To build a successful line of defense, KIAP associates held their own legal investigation, which resulted in compiling an impressive evidence base proving that the transactions were real: statements of accounts, contracts, KS-2, KS-3 statements, as-built documentation, state expertise opinions, etc.

As a result, the court refused to bring the Firm’s Principal to vicarious liability, and the judicial act was based on the evidence collected by KIAP.
