For the past three years, KIAP’s international arbitration practice has been actively involved in cases related to the application of Articles 248.1 and 248.2 of the Russian Arbitrazh (Commercial) Procedure Code (also known as Lugovoy Law). Our team has been diligently tracking all the cases where these provisions have been applied.
We are pleased to share the updated Alert with statistics based on 480 cases, which reflect all Russian court cases on Lugovoy Law from a landmark decision on Uralvagonzavod up to the end of August 2024.
The head of practice Stepan Sultanov and associate Anastasiya Ryabova have substantially upgraded the previous alert by incorporating key recent developments. In response to numerous requests from our clients and colleagues, we have now also prepared the alert and the statistical conclusions in English.
Additionally, we are conducting a survey within the Russian-speaking community on their experience on application of Lugovoy Law. More details about the survey are available here (in Russian). We will publish the results after November 15, 2024, both in Russian and English.
