At a major pulp and paper plant of the insured equipment insured against property risks was damaged. During the adjustment of the claim the insurer indemnified the cost of the damage but substantially reduced the BI (business interruption) payment on the ground that the insured had been able partially to compensate for the losses incurred as a result of the insured event during the post‑loss period.
KIAP Law Firm's lawyers analysed the circumstances of the case and developed a system of arguments which allowed the client to recover the insurance indemnity in full.
